When a passenger is killed in a car accident, his or her estate has a “wrongful death” claim against the insurance companies for all drivers who are partially at-fault for the crash. It is important to involve an experienced personal injury attorney right away to make sure the facts of the accident are properly investigated and all available insurance coverage accounted for. Sometimes, an investigation may show that a family member who was driving at the time of the accident was partially at-fault for the crash. Fortunately, in Wisconsin, injured passengers can make claims directly against the negligent driver’s insurance company without needing to sue the driver individually.
